Adlington Golf Centre Terms and Conditions

The terms of use below constitute a legal Agreement between you (Herein referred to as “The Customer”) and Adlington Golf Centre. (Herein referred to as “The Company”), legal owner of the domain name and web site adlingtongolfcentre.co.uk (Herein referred to as “The Website”), each referred to herein as a “Party” and collectively as the “Parties”. Your agreement to be bound by these terms is acknowledged by your use of the Company Services which includes, but is not limited to visiting the website, using its internal and external links for search of information, contacting Company representatives, Support Services and/or any software made available to you by Company.

Any information posted in relation with any Company services or products is only informational and does not govern the relationship between The Company and its customer in connection to any Company products or services. These relationships are governed by the specific this Terms of Use Agreement and the Privacy Agreement.

WE DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY, ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND THE IMPLIED CONDITIONS OF SATISFACTORY QUALITY.

Limited Liability.

IN NO EVENT SHALL Adlington Golf Centre, AFFILIATES, AGENTS OR CONTRACTORS BE LIABLE FOR ANY COMPENSATORY, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, LOSS OF DATA, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY, OR ANY CLAIMS OF YOU OR OTHER THIRD PARTIES WHATSOEVER.

You agree to indemnify, defend, and hold harmless Adlington Golf Centre representatives, vendors and distributors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that such parties may incur as a result of or arising from your (or anyone using your account’s) violation or breach of any terms under this Agreement. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you and, in such case, you agree to cooperate with our defense of such claim.

Entire Agreement/No Waiver.

This Agreement constitutes the entire agreement of the parties with respect to the subject matter hereof. The captions are used only as a matter of convenience and are not to be considered a part of this agreement or be used in determining the intent of the parties to it. No waiver by Adlington Golf Centre of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.

Correction of Errors and Inaccuracies.

The Adlington Golf Centre Website and any correspondence related to a transaction may contain typographical errors or other errors or inaccuracies and may not be complete or current. Adlington Golf Centre therefore reserves the right to correct any errors, inaccuracies or omissions and to change or update the Content at any time without prior notice. Adlington Golf Centre does not, however, guarantee that any errors, inaccuracies, or omissions will be corrected.

Adlington Golf Centre reserves the right to modify this Agreement at any time. If you do not agree to the changes, you may discontinue using the Adlington Golf Centre Websites and/or the Adlington Golf Centre Services before the changes take effect. The last date this Agreement was revised is set forth below. Terms and conditions modifying the Agreement are effective immediately upon posting.

Applicable Law and Venue.

THIS AGREEMENT IS GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH UNITED KINGDOM LAW WILL APPLY TO THESE TERMS AND CONDITIONS. BY USING THIS SITE AFTER ACCEPTING COOKIES AND TERMS, YOU AGREE THAT ANY ACTION AT LAW OR INEQUITY ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS WILL BE FILED ONLY IN COURT LOCATED IN THE UNITED KINGDOM, AND YOU HEREBY IRREVOCABLY AND UNCONDITIONALLY CONSENT AND SUBMIT TO THE EXCLUSIVE JURISDICTION OF SUCH COURTS OVER ANY SUIT, ACTION, OR PROCEEDING ARISING OUT OF THESE TERMS AND CONDITIONS. ALL DISPUTES MUST BE ADJUDICATED IN THE ENGLISH LANGUAGE.

Gift Card & Golf Card Term & Conditions.

(1) Gift cards and golf cards can be used to purchase anything at Adlington Golf centre.(2) Gift cards and golf cards cannot be exchange for cash. (3) This card is not a cheque guarantee, credit or charge card. (4) No change will be given when using gift or golf cards although the balance which will be shown on the receipt may be applied towards future purchases. (5) Gift cards may be used to purchase items of a higher value than the balance on the giftcard upon full payment of the difference. (6) please protect this gift cards and golf card and treat it like cash Adlington Golf Centre cannot be held liable for lost or stolen cards or any amount held on such cards. (7) The amount of the value redeemed and the cards balance will be shown on the till receipt after each transaction. (8) Gift cards are valid for 24 months from the date that the card is last used any remaining balance will be cancelled. (9) Adlington Golf Centre reserves the right to adjust the product pricing at any time of the year. The product price list is not fixed at the time of top up. (10) Adlington Golf Centre reserves the right to amend these terms and conditions from time to time where it reasonably considers it necessary to do so. (11) Golf Card discounts do not apply to group bookings – the golf card can be used but the full value will be deducted from the card balance. (12) Golf Card discount levels are not available in conjunction with promotional or already discounted offers.
